ARTICLE 2- SUBJECT OF THE AGREEMENT: The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures for the Application of Distance Contracts, regarding the sale and delivery of goods/services ordered by the Buyer electronically from the Seller's website www.nutrafine.com, which possess the characteristics mentioned in the agreement and whose sales price is specified in the agreement. The Buyer acknowledges and declares by the terms of this agreement that they have knowledge of the basic characteristics, sales price, payment method, delivery conditions, etc. of the goods/services subject to sale, all preliminary information related to the goods/services subject to sale, and the right of withdrawal, that they have confirmed this preliminary information electronically, and that they subsequently placed an order for the goods/services. The preliminary information on the payment page of www.nutrafine.com and the invoice are integral parts of this agreement.

ARTICLE 3- DATE OF AGREEMENT: This agreement, previously prepared by the Seller, was electronically approved and accepted by the buyer on ............. and a copy will be sent to the buyer's email address.

ARTICLE 4- DELIVERY OF GOODS/SERVICES, PLACE OF PERFORMANCE OF THE AGREEMENT AND DELIVERY METHOD: The goods/services will be delivered to the .......... email address requested by the buyer for delivery.

ARTICLE 5- DELIVERY COSTS AND PERFORMANCE: Delivery costs belong to the buyer. If the Seller declares on its website that it will cover the delivery fee for purchases exceeding a certain amount, the delivery cost belongs to the seller. Delivery is made as soon as possible after the stock is available and the price of the goods is transferred to the seller's account. The Seller delivers the goods/services within a maximum of 30 (thirty) days from the order and reserves the right to extend this period by an additional 10 (ten) days with written notification. If the price of the goods/services is not paid for any reason or is canceled in the bank records, the seller is deemed to be released from the obligation to deliver the goods/services.

ARTICLE 6- BUYER'S STATEMENTS AND COMMITMENTS: The Buyer will inspect the goods/services subject to the contract before receiving them and will not accept damaged or defective goods/services such as dents, breaks, torn packaging, etc., from the cargo company. This means that the received goods/services are accepted as undamaged and sound. The obligation to carefully protect the goods/services after delivery belongs to the buyer. If the bank or financial institution concerned does not pay the Seller for the goods/services due to unauthorized or unlawful use of the buyer's credit card by unauthorized persons, without fault of the buyer, after the delivery of the goods/services, the buyer is obliged to send the goods/services and the invoice to the seller within 3 (three) days, provided that they have been delivered to them. If the buyer has created a defect on the goods/services after delivery that prevents their resale, the buyer is obliged to compensate the price of the goods/services. In all cases, shipping costs belong to the BUYER.

ARTICLE 7- SELLER'S STATEMENTS AND COMMITMENTS: The Seller is responsible for delivering the goods/services subject to the contract in sound and complete condition, in accordance with the specifications stated in the order, and with guarantee documents and user manuals, if any. If the goods/services subject to the contract are to be delivered to a person/organization other than the Buyer, the Seller cannot be held responsible if the recipient person/organization does not accept the delivery. The Seller returns the price of the goods/services, and any valuable papers if any, within 7 (seven) days after receiving the declaration of withdrawal. The SELLER takes back the goods/services within 20 (twenty) days. With justified reasons, the seller may supply equivalent quality and price to the buyer before the performance period specified in the contract expires. If the seller believes that the performance of the goods/services has become impossible, he notifies the buyer before the performance period of the contract expires. The paid amount and any documents are returned within 20 (twenty) days. Defective or faulty goods/services, whether or not they are sold with a guarantee certificate, can be sent to the seller for necessary repairs under warranty conditions, in which case delivery costs will be borne by the Buyer.

ARTICLE 8- CHARACTERISTICS OF THE GOODS/SERVICES SUBJECT TO THE AGREEMENT: The type and nature, quantity, brand/model, color of the goods/services, and the sales price including all taxes are as stated in the information on the goods/services promotion page on the website www.nutrafine.com and in the invoice which is considered an integral part of this agreement.

ARTICLE 9- CASH PRICE OF THE GOODS/SERVICES: The cash price of the goods/services is included in the invoice content sent to the customer along with the product after the order.

ARTICLE 10- DEFERRED PRICE: The price of the goods/services according to the deferment made on the sales price is included in the sample invoice sent by email after the order and in the invoice content sent to the customer along with the product.

ARTICLE 11- INTEREST: It cannot exceed the interest rate determined by the Government of the Republic of Turkey each year and in any case 30%. The Buyer is responsible to the bank with which they work, pursuant to the provisions of Article 13.

ARTICLE 12- DOWN PAYMENT AMOUNT: The down payment amount of the goods/services is included in the sample invoice sent by email after the order and in the invoice content sent to the customer along with the product.

ARTICLE 13- PAYMENT PLAN: If the Buyer makes purchases with a credit card and in installments, the installment method chosen from the website is valid. In installment transactions, the relevant provisions of the agreement signed between the Buyer and the cardholder bank apply. The credit card payment date is determined by the provisions of the agreement between the bank and the buyer. The Buyer can also track the number of installments and their payments from the account statement sent by the bank.

ARTICLE 14- RIGHT OF WITHDRAWAL: The Buyer may exercise the right of withdrawal within 7 (seven) days from the date of delivery of the goods/services subject to the contract to themselves or to the person/organization at the address indicated by them. To exercise the right of withdrawal, notification must be made to the Seller via email within the same period, and it is mandatory that the packaging and contents of the goods/services have not been damaged during testing and are suitable for resale, in accordance with the provisions of Article 15 and the preliminary information published on the www.nutrafine.com website, which is an integral part of this agreement. In case this right is exercised, the original invoice for the goods/services delivered to the 3rd party or the Buyer must be returned. The price of the goods/services is returned to the Buyer within 7 days following the receipt of the notification regarding the right of withdrawal, and the goods/services are taken back within 20 (twenty) days. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded to the Buyer. The delivery and shipping cost of the goods/services returned due to the right of withdrawal shall be borne by the Buyer.

ARTICLE 15- GOODS/SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED: Goods/services that are not suitable for return due to their nature, rapidly perishable goods/services, goods/services with an expired shelf life, single-use goods/services, and all kinds of reproducible software and programs. Additionally, for all kinds of software and programs, DVD, DIVX, VCD, CD, MD, video cassettes, computer and stationery consumables (toner, cartridge, ribbon, etc.) and cosmetic materials, it is a condition for exercising the right of withdrawal that the original packaging of the goods/services must be unopened, undamaged, and unused.

ARTICLE 16- DEFAULT AND LEGAL CONSEQUENCES: If the Buyer defaults on transactions made with a credit card, they will pay interest and be responsible to the cardholder bank within the framework of the credit card agreement made with them. In this case, the relevant bank may resort to legal remedies; it may demand resulting expenses and attorney's fees from the Buyer, and in any case, if the Buyer defaults on their debt, the Buyer agrees to pay the Seller's loss and damage incurred due to the delayed performance of the debt.

ARTICLE 17- AUTHORIZED COURT: In disputes that may arise from this agreement, Consumer Arbitration Committees are authorized up to the value declared by the Ministry of Industry and Trade, and Consumer Courts are authorized for disputes exceeding this value. In places where Consumer Courts are not available, Civil Courts of First Instance are authorized.
